Website & Service Terms
Terms & Conditions
A clear guide to working with Jean Tamesa Digital Co, from website access to service agreements.
1. Acceptance
These Terms govern access to jeantamesadigitalco.com and the general website services of Jean Tamesa Digital Co. By using the site, you agree to applicable Terms. Specific client services are governed by your accepted proposal, statement of work or signed agreement; where they conflict, that agreement controls.
2. Services
We offer digital strategy, branding, web design and development, SEO and AI search optimisation, social media, advertising support, content, analytics, email marketing, automation and related services. Scope, deliverables, fees, milestones and exclusions are defined in the specific project agreement.
3. Eligibility and Accounts
You must be legally capable of agreeing to these Terms. Business representatives must have authority to act for their organisation. Keep credentials confidential and notify us promptly about suspected unauthorised access.
4. Client Responsibilities
Clients must provide lawful, accurate and timely content, approvals, account access, design assets and instructions. You confirm that you hold sufficient rights to materials supplied for use in your project. Delays in approvals or materials may affect the project schedule.
5. Quotes and Payments
Fees, payment deadlines, taxes and currency are set out in the accepted proposal, invoice or checkout terms. Any extra work requires mutual approval. Client payment processing may be handled by third party providers with their own terms.
6. Changes, Cancellation and Refunds
Cancellation, changes and refunds follow the specific service agreement and any mandatory consumer law. Completed custom work and delivered digital products may be non refundable where legally permitted. No provision removes non waivable rights.
7. Ownership and Licences
Each party retains its pre existing intellectual property. Client ownership or licence rights in final paid deliverables are as specified in the project agreement. Third party stock, fonts, software, plugins and themes remain subject to third party licences. Unpaid drafts and unaccepted concepts may not be reused without permission.
8. Client Materials and Confidentiality
Clients retain rights in materials supplied to us and authorise our limited use as needed to perform the agreed services. Confidentiality obligations in an NDA or service agreement take precedence. We will not publish confidential client work without appropriate authorisation.
9. Third Party Services
Web hosting, search engines, analytics tools, payment platforms, social media, plugins and advertising networks are independently operated. We cannot guarantee their continuous availability, policies, pricing or algorithm behaviour.
10. Marketing and SEO Results
Traffic, rankings, sales, bookings, advertising results and other performance outcomes depend on factors outside our control. Unless expressly stated in an agreement, we do not guarantee particular positions, leads, revenue or return on investment. Projections are estimates, not promises.
11. Acceptable Use
Do not use the site or our systems for unlawful activity, infringement, deception, harassment, malware, unauthorised scraping, intrusion or any attempt to disrupt the service. We may limit access when reasonably necessary to prevent abuse or protect legal rights.
12. Privacy
Our Privacy Policy explains personal information processing. Client data processing may also be addressed in a signed data processing agreement or other contractual terms.
13. Disclaimers
Website materials are general business information, not legal, tax or professional advice. We aim for accuracy but the website may not always be available or error free. Any disclaimers operate only to the extent permitted by applicable law.
14. Liability
To the extent allowed by law, we are not liable for indirect, incidental or consequential losses arising from website use. Nothing excludes fraud, wilful misconduct, statutory consumer protection or any liability that the applicable law prohibits us from excluding. Additional liability terms may appear in your contract.
15. Governing Law and Disputes
Unless your written agreement states otherwise, these Terms are interpreted under the laws of the Republic of the Philippines, subject to any mandatory protections that apply in your home jurisdiction. Parties should first try to resolve concerns by good faith discussions.
16. Updates
We may update website Terms prospectively where permitted by law. Updates appear on this page with a new effective date. Existing signed agreements are not changed solely by updating these website Terms.
